API Terms of Service


Scope

All of the content, documentation, code and related materials made available to you through the AMS website is subject to these terms. Accessing or using our services or content constitutes acceptance to this Agreement.

Use

You may use the AMS API to develop a service or services to search, display, analyze, retrieve, and view AMS data.  Data accessed through the AMS website does not include controls over its end use. But, as the data owners and/or authoritative source, AMS retains all version control. Once data has been downloaded from our site, the U.S. Government cannot vouch for the quality or currentness of the analyses or products created based on the data.

Attribution

All services using or accessing the API should display prominently within the application: “This product uses USDA’s National Farmers Market API but is not endorsed or certified by USDA.”  USDA or AMS logos may not be used on products (including Web pages) that are not produced or sponsored by USDA or USDA employees.

Public Participation

As part of our ongoing efforts under the Transparency and Open Government Initiative, any feedback and input from members of the public will help contribute to the continued improvement and evolution of our APIs and open data sets.

Modification or False Representation of Content

Users of AMS data may not modify or falsely represent content accessed through the AMS website and still attribute the source as AMS or USDA.

Right to Limit

Use of our APIs may be subject to certain limitations on access, calls, or use as set forth within this Agreement or otherwise established by AMS. If USDA or AMS has reason to believe that a user has attempted to exceed or circumvent these limits, use of the API may be temporarily or permanently blocked.

USDA and AMS may monitor use of these services to both improve the service, and to insure that use adheres to this Agreement.

Changes

USDA and AMS reserve the right to modify or replace this Agreement, in whole or in part. Continued use of or access to the AMS services following any changes to this Agreement constitutes acceptance of those modified terms. Any new features or services AMS may offer in the future shall also be subject to the terms and conditions of this Agreement.

Disclaimer of Warranties

All AMS services are provided “as is” and on an “as-available” basis. AMS makes no warranty that the services will be error free or that access will be continuous or uninterrupted.

Limitations on Liability

In no event will AMS be liable with to respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (1) any special, incidental, or consequential damages; (2) the cost of procurement of substitute products or services; or (3) for interruption of use or loss or corruption of data.

General Representations

Use of the services will be in strict accordance with the AMS privacy policy, this Agreement, and all applicable laws and regulations, and use of the services will not infringe or misappropriate the intellectual property rights of any third party.

Indemnification

You agree to indemnify and hold harmless AMS, the U.S. Department of Agriculture, its contractors, employees, agents, and the like from and against any and all claims and expenses, including attorney’s fees, arising out of your use of the API, including but not limited to violation of this Agreement.

Disputes

Any disputes arising out of this Agreement and access to or use of the data or services shall be governed by federal law.

No Waiver of Rights

AMS’ failure to exercise or enforce any right or provision of this Agreement does not constitute waiver of such right or provision.
